Class 2 misdemeanor traffic offenses are less severe and can result in up to ninety days in jail and a fine of up to $300. These may be enhanced in school or construction zones. Class 1 misdemeanor traffic offenses carry a jail sentence of up to one year and a fine of $1,000. All misdemeanor offenses require payment of court costs and surcharges.

A conviction for a misdemeanor traffic offense may also obligate a defendant to perform public service, pay restitution, or other legal penalties.

Criminal Misdemeanor Offenses

Criminal misdemeanor offenses are more serious than misdemeanor traffic offense tickets. These may include DUI or DWAI.

Felony Traffic Offenses

Felony traffic offenses typically involve a deliberate act by the motorist. Examples of felony traffic offenses are failure to remain at the scene of an accident and operating a motor vehicle in a reckless manner if that was the proximate cause of death of another person.
