At Troxell Law, our Garfield County family law lawyers handle all varieties of matters within the vast realm of civil family law as well as those that touch the juvenile court system. As a client-centered firm, our attorneys are prepared to help you legally achieve all of your family law goals throughout the court system.

Most family law cases are centered around marriage and the family as family law’s primary function is dealing with family-related and domestic relations issues. Family law case types may include any of the following and more:

  • Divorce;
  • Property division;
  • Spousal support;
  • Child custody and visitation;
  • Child support;
  • Pre and postnuptial agreements;
  • Paternity; and
  • Adoption.

Domestic violence can be part of both a civil and criminal law proceeding. A juvenile delinquency matter, although handled in a distinct type of court, is much the same.

Garfield County Family Law Overview

The following is a brief overview of common family law actions in Garfield County. For more information about these or any other family law procedure, seek the advice of an experienced Garfield County family law attorney.

Divorce in Garfield County

There is a residency requirement to file for divorce in Colorado. Colorado requires a spouse reside in the state for at least ninety-one days before filing.

Colorado is considered a no-fault divorce state. This means that neither spouse must prove grounds to divorce the other. Instead, spouses are divorced on the grounds of the assertion that the marriage is irretrievably broken.

Colorado does have a mandatory waiting period before the court will grant a divorce. Essentially the court will not grant a divorce on the same day a divorce is filed.

Property division in a Colorado divorce is by equitable distribution. This is a fair division, not necessarily an equal division. Therefore one spouse may end up with greater or lesser portions of property or debts than the other.

Child Custody and Visitation in Garfield County

Colorado calls child custody and parenting time allocation of parental responsibilities. The family court bases its decisions regarding the allocation of parental responsibilities on the best interests of the child standard. Several statutory factors go into the court’s determination as to which parent has responsibility for specific events in a child’s life.

Child Support in Garfield County

Colorado calculates child support by the Income Shares Model. This takes both parents’ incomes into account and utilizes a complex system of worksheets to determine the amount of support paid monthly and to whom.

Paternity in Garfield County

Paternity or establishing parentage can be done by a child’s mother or father through a court motion. It is a means of gaining the legal right to child support, allocation of parental responsibilities, and access to critical information and benefits for a child.
